How to Get Kyogre in Pokemon SoulSilver without trading

Kyogre in "Pokemon Sapphire" or "Pokemon Emerald"

  Capture a Kyogre in either "Pokemon Sapphire" (located in the Cave of Origin) or "Pokemon Emerald" (located in the Marine Cave).

  Obtain at least five other Pokemon.

  Place the captured Kyogre and other Pokemon in BOX1 on any of the PCs located in any of the town Pokemon Centers.

Migrate Kyogre to "Pokemon SoulSilver"

  Insert a "Pokemon Sapphire" or "Pokemon Emerald" cartridge into the Game Boy Advance slot (labeled SLOT-2) on the bottom of the Nintendo DS. The DS should also have "Pokemon SoulSilver" placed in the DS card slot (labeled SLOT-1).

  Turn on the Nintendo DS and select "Pokemon SoulSilver." Once you are at the game's main menu screen, the option "MIGRATE FROM SAPPHIRE" or "MIGRATE FROM EMERALD" will appear.

  Select ""MIGRATE FROM SAPPHIRE" or "MIGRATE FROM EMERALD." You will be asked if you want to make the Pokemon migrate. Select "YES" twice. The next screen will display the Pokemon stored in your PC Box on the "Pokemon Emerald" or "Pokemon Sapphire" game.

  Select Kyogre and five other Pokemon from the screen and choose "YES" when prompted to continue. The Pokemon data then will be saved to the "Pokemon SoulSilver" DS card. The game will return to the main menu.

  Start your existing "Pokemon SoulSilver" game and enter the Pal Park located at the northern end of Fuchsia City.

  Make your way into the main building (with a Pokeball logo above its doorway) and speak with the man behind the counter. He will ask if you want to take part in the Catching Show. Select "YES" and the man will step out of the way.

  Walk out of the back door into the Pal Park. Go right toward the Sea section. Here a battle will begin with Kyogre and you will have the option to throw a Pokeball.

  Select "Ball" and the Kyogre will be captured.
